UKGC Cites Future Publication in Spending Data Refusal

The UK Gambling Commission (UKGC) has withheld its spending and transparency data for the second quarter of 2023, following a Freedom of Information (FOI) request. The regulator has stated the information will be published later in the year as part of its established biannual schedule.

The request, dated 8 August 2023, sought access to the Commission's spending records for the period of April to June 2023, which were not available on its website at the time. In its official response, the UKGC declined to provide the data ahead of schedule.

Why This Data Matters

The UKGC is funded primarily by the licence fees paid by gambling operators. Its spending data provides a crucial window into the organisation's priorities and operational focus. For consumers, this information reveals how funds are allocated towards key areas such as enforcement against non-compliant operators, research into gambling harms, and the development of safer gambling policies. Transparency in its spending is essential for holding the regulator accountable for its mission to make gambling in Great Britain fairer and safer.

Details of the FOI Response

The Commission invoked Section 22 of the Freedom of Information Act 2000, which provides an exemption for information that is intended for future publication. According to the response, the UKGC publishes its Cabinet Office disclosure requirements, including spending data, twice a year in May and November.

The UKGC acknowledged a legitimate public interest in promoting transparency and accountability. However, it argued that fulfilling individual FOI requests for this data outside of its publication cycle was not a "time/cost effective" use of its resources.

After weighing the arguments, the Commission concluded that the public interest was better served by maintaining its biannual publication timetable. The response noted that this schedule has now been clarified on the Commission's website.

Significance for Regulatory Oversight

While the spending data for April to June 2023 will eventually be made public, the UKGC's decision means that consumers, researchers, and industry observers must wait until the scheduled November release. This delays scrutiny of the regulator's financial activities during a key period.

The response highlights the balance public bodies must strike between immediate transparency under FOI law and their own internal publication processes. For those monitoring the UKGC's performance and priorities, this decision reinforces that access to certain data is strictly governed by the Commission's own timetable.
