UKGC Cites Lack of Clarity in BetIndex FOI Request

The UK Gambling Commission (UKGC) has withheld information regarding evidence it received about the financial liquidity of collapsed operator BetIndex. In response to a Freedom of Information (FOI) request dated 11 November 2024, the regulator stated the query was not clear enough to identify and locate the relevant documents.

This response effectively blocks access to potentially crucial information about the Commission's oversight of BetIndex, the company behind the Football Index platform, before its high-profile collapse in March 2021.

Context: Scrutiny Over BetIndex Collapse

The failure of BetIndex and its Football Index product resulted in significant consumer losses, estimated to be in the millions of pounds. The event triggered an independent review and intense scrutiny of the UKGC's regulatory actions, or lack thereof, in the lead-up to the company's administration.

This FOI request sought to shed light on a specific moment in the timeline. The requestor referenced an alleged internal UKGC email from 6 July 2021, which purportedly stated that the Commission had received evidence from BetIndex and that its queries regarding the operator's liquidity had been “satisfied.” The request asked for this evidence and any related correspondence.

Details of the FOI Response

Instead of providing the information or refusing on statutory exemption grounds, the UKGC returned the request for clarification. The Commission's response stated: “Unfortunately, your request is not sufficiently clear to enable us to locate or identify the recorded information you are requesting.”

The regulator claimed it was unable to definitively identify the email or a “separate document” mentioned by the requestor. It has asked the individual to provide further details, including:

  • Where the email was published, its author, or its recipient.
  • The title, author, and date of the separate document.
  • Further clarification on the nature of the correspondence being sought.

The UKGC noted that a clarified query would be treated as a new request, restarting the 20-working-day response clock.

Significance: A Barrier to Transparency

For consumers and observers seeking to understand the chain of events that led to the BetIndex failure, this response represents a significant hurdle. It places the burden of proof on the requestor to possess highly specific details about internal regulatory documents—information they are unlikely to have without prior disclosure.

While not an outright refusal based on a legal exemption, the outcome is the same: the information remains withheld from public view. This highlights the challenges involved in using the FOI process to scrutinise the actions of a public body in relation to a major consumer protection failure. The decision leaves key questions about the UKGC's assessment of BetIndex's financial stability unanswered.
