UKGC Withholds Betfair 'Special Measures' Report

The UK Gambling Commission (UKGC) has refused to release a report detailing why betting giant Betfair was placed under 'special measures', according to a Freedom of Information (FOI) response dated 20 July 2023.
While the regulator withheld the full report, it confirmed that Betfair had divested £635,123 as a result of the process, which was triggered by failings in social responsibility and anti-money laundering (AML) controls.
The Request and Refusal
A member of the public requested a copy of the 'Special Measures' report into Betfair and asked for details on where the associated £635,123 divestment was directed.
The UKGC denied the request for the report, citing Section 31 of the FOIA, which protects information that could prejudice a public authority's ability to exercise its functions. The regulator argued that its ability to police the industry relies heavily on operators providing information voluntarily.
In its response, the Commission stated that disclosure "would undermine the willingness of operators to provide information on a voluntary basis and accordingly prejudice the ability of the Commission to discharge its regulatory functions." It also warned that releasing such details could allow non-compliant operators to alter their behaviour strategically to pass assessments without making genuine improvements.
What are 'Special Measures'?
The UKGC uses the 'special measures' process as a regulatory tool to bring operators who need to make "key improvements" into compliance as quickly as possible. It is a serious step short of a formal licence review or suspension.
The regulator confirmed that Betfair was placed into this process due to concerns over its social responsibility and AML policies. It also noted that the operator successfully exited the process in May 2021 after the UKGC was satisfied it was "implementing effective policies and processes aimed at keeping gambling fair, safe and crime free."

The FOI response did provide clarity on the financial penalty. Betfair divested a total of £635,123 as a result of its failings.
These funds were directed to "charities furthering the National Strategy to Reduce Gambling Harms." The response did not name the specific charities that received the funds but pointed to a general list on its website for destinations of regulatory settlements.
