The UK Gambling Commission (UKGC) has released email correspondence between itself and the legal firm Henderson Chambers concerning the collapsed gambling operator BetIndex. The documents, disclosed following a Freedom of Information (FOI) request dated 25 April 2023, cover a critical period following the operator's suspension but are heavily redacted, limiting public insight into the regulatory aftermath.
The Request and The Response
The FOI request sought all email correspondence between the UKGC and Henderson Chambers regarding the regulation of BetIndex from 1 June 2021 to 21 September 2021. This period is significant as it follows the March 2021 suspension of BetIndex's operating licence, an event that led to the company's administration and substantial losses for many customers.
In its response, the Commission confirmed it held relevant information and provided a 22.9 MB PDF file containing the emails. However, the disclosure was made with a 'partial exemption', meaning significant portions of the information were withheld from the public.
Why The Information Was Redacted
The UKGC cited section 40(2) of the Freedom of Information Act 2000 as the reason for the redactions. This section protects personal data. The Commission stated that disclosing the redacted information would contravene the Data Protection Act 2018.
According to the response, the redacted information includes:
- Names of identifiable individuals
- Email addresses
- Opinions
- Any other personal identifiable information
The decision to redact 'opinions' under the personal data exemption is notable. It means that the professional views and advice exchanged between the regulator and its legal counsel on the BetIndex case are not visible to the public.
Significance for Consumers
This disclosure confirms that the Gambling Commission engaged external legal experts from Henderson Chambers to navigate the complex regulatory issues arising from the collapse of BetIndex. For consumers, particularly those affected by the operator's failure, this correspondence could have offered valuable insight into the regulator's decision-making process during a crucial time.
However, the extensive redactions mean that a complete picture of the legal strategy and internal discussions remains hidden. While the protection of personal data is a legal requirement, the withholding of 'opinions' obscures the substance of the advice given and the regulator's response to it. This lack of transparency makes it difficult for the public to fully scrutinise the UKGC's handling of one of the most high-profile collapses in the UK's regulated gambling market.
