UKGC Does Not Hold White-Label Operator Contracts

A Freedom of Information (FOI) response from the UK Gambling Commission (UKGC) has revealed that the regulator does not hold or review the specific contracts between white-label platform providers and the gambling brands that operate under their licence.

The disclosure, published following a request dated 22 September 2023, confirms a significant detail about the UK's regulatory framework and how it oversees the increasingly common white-label model.

Context: The White-Label Model

For consumers, understanding the structure of the UK gambling market is crucial. Many betting sites are not independent companies but 'white labels'. This means they are brands that use the gambling licence, software, and operational services of a larger, established company.

In this case, the brands 8XBet and 6686 are white labels operated by TGP Europe Limited. While a customer interacts with the 8XBet or 6686 website, the legal and regulatory responsibility for their activity ultimately rests with TGP Europe, the holder of the UKGC licence.

This distinction is vital for consumer protection, as any disputes or compliance issues are handled at the level of the licence holder, not the consumer-facing brand.

Details of the FOI Request

The FOI request sought specific details about the business relationship between these companies, asking for:

  • The names, titles, and companies of individuals who signed the contracts between TGP Europe and 8XBet.
  • The same signatory details for the contract between TGP Europe and 6686.
  • The dates on which these contracts were signed.

In its response, the Gambling Commission stated that it held no information falling within the scope of the request.

The regulator explained that it is made aware of these partnerships when the licence holder, TGP Europe, submits a 'key event' notification. Under Licence Condition 15.2.1, a key event is anything that could significantly impact the structure of the licensee's business. However, the UKGC clarified its process:

"No contracts are attached to the key events. However, this would not be requested as part of the process. As such, no information is held falling within the scope of your request."

Significance for Consumers and Industry

This response confirms that the UKGC's oversight of white-label arrangements relies on the primary licence holder's reporting and overall compliance, rather than a direct review of the contractual terms governing the partnership.

For consumers, this highlights two key points:

Accountability Rests with the Licence Holder: The responsibility for ensuring a white-label brand adheres to UK regulations on fairness, safety, and marketing lies entirely with the main licence holder (e.g., TGP Europe).
