UKGC Withholds Spending Data, Citing Future Publication

The UK Gambling Commission (UKGC) has withheld its spending and transparency data for the second quarter of 2024, stating the information will be published on a pre-determined schedule. The decision came in response to a Freedom of Information (FOI) request filed on 2 September 2024.

The request sought access to the Commission's spending data for the period of April 2024 to June 2024. This information is part of the Cabinet Office's disclosure requirements, which mandate that public bodies publish details of their expenditure to ensure transparency and accountability.

In its response, the UKGC confirmed it holds the information but has applied an exemption under Section 22 of the Freedom of Information Act 2000, which covers "information that is intended to be published in the future."

As the regulatory body for gambling in Great Britain, the UKGC is funded by the licence fees paid by gambling operators. Its spending data provides a crucial window into how it allocates resources. The UKGC conducted a public interest test to justify withholding the information until then. It acknowledged the public interest in promoting transparency but argued that this was outweighed by the need to maintain a cost-effective and orderly publication schedule.

According to the regulator, providing the information in response to individual FOI requests ahead of schedule is not an efficient use of public resources. The Commission stated, "There is no outstanding public interest in releasing this information prior to its intended publication. Given the necessary preparation and administration involved in publishing the information, we consider that our publication timetable is reasonable."

This response clarifies the UKGC's process for financial disclosure. While the spending data is not being permanently concealed, access is limited to a fixed, bi-annual timetable. This means that consumers, researchers, and journalists seeking the most current financial data must wait for the official publication dates.
